When property buyers need protection related to property rights, negotiations must be carried out by both parties involved in the transaction by providing an Arkansas Deed of Warranty.
This legal document serves as a medium for the verification process in which it states that the property (real estate) being transferred is free from all claims and liens.
In order for this deed of warranty to be in line with the provisions of Sections 18-12 of the Arkansas Code, the title is free from any form of disability.
Then, the deed must also be signed by involving at least two witnesses and performed in front of a public official. Furthermore, the completed deed is submitted to the district registrar for registration of a copy of the deed.
Compared to the Quitclaim Deed, many people prefer to use a deed warranty because it accommodates more protection for the buyer.
